AGREEMENT BETWEEN WEBSITE USER (ALSO REFERRED TO IN THIS AGREEMENT AS “VISITOR” AND “YOU”/“YOUR”) AND ALEXIS THE GREEK (ALSO REFERRED TO IN THIS AGREEMENT AS “AG”, “THE SITE,” “THE WEBSITE,” “ALEXIS THE GREEK DIGITAL MEDIA LLC” AND “ALEXISTHEGREEK.COM”):

Terms and Conditions of Use

Use of this website is governed by the Terms of Use set forth. Please read all terms carefully before using this website or signing on for course memberships, desktop or mobile preset memberships, or free membership plans.

By using, accessing or downloading materials, including free educational content, from this website, you agree to follow the terms and provisions as outlined in these Terms of Use (also referred to in this Agreement as “Terms”), which apply to this and all future visits to and uses of alexisthegreek.com.

AG may at any time revise and update these Terms, and these revisions may or may not be followed by written notice to Members or in the form of a notification on the website. Please return to this Terms of Use Agreement if you believe the Terms may have changed due to new business law or internet regulations, and at least once per calendar year to review the most current Terms to which you are bound. If you do not agree to the Terms, please do not use this alexisthegreek.com.

Registration and Your Information

If you would like to make use of certain services, such as our course memberships, desktop or mobile preset memberships, or free membership plans, you will need to create an account with alexisthegreek.com (“Account”). Please ensure the information you provide is accurate, current and complete. Any information suspected to be provided under deliberately false pretenses can result in suspension or cancellation of your Account.

You understand that any password you create is yours alone, not to be shared, and is not accessible to anyone at Alexis The Greek. (If you forget your password, there are options in place to update your password after verification that you are the owner of the Account in question.)

Information we collect in order to activate your Account is limited to what is essential to create a username and password for you, which will allow you access to restricted pages of this Site, and/or billing information. The forms used to collect this information are created and provided by a third-party software application known as MemberSpace, operated by SwanLogic LLC, and this company has its own set of Terms of Use and Privacy Policy. By using this Membership Services at alexisthegreek.com, you acknowledge that you give permission for MemberSpace to process your information, and you acknowledge that you accept their Privacy Policy.

USER BEHAVIOR

Users and Members will only be permitted to remain on and use the Site insomuch as they refrain from discrimination and hate speech. Any language or behavior which may be construed by the officers, directors, employees, agents, or affiliates of Alexis The Greek to be discriminatory on the basis of any of the following or any other reason may result in temporary suspension or permanent termination of any applicable Membership or use of the Site: age, race, ethnicity, sex/gender, sexual orientation, faith, religion, political beliefs, occupation, and/or disability. Any language, behavior, or content which indicates any aggression, violence, abuse, bullying, or imminent threat, if noticed or brought to the attention of the officers, directors, employees, agents, or content creation team at AG will result in an immediate ban and if necessary a formal report to legal authorities.

PURCHASE OF SERVICES (MEMBERSHIPS): ACCOUNTS, USER INFORMATION, & REFUNDS

All Services and prices described on this website are subject to change at any time without notice. Periodic sales and discount codes are used to promote memberships and tangible goods, and such promotions are constrained to purchases made within the window of time which the sales and discount codes are active; sales and discounts cannot be applied to previous purchases. 

Memberships at alexisthegreek.com are considered digital goods which cannot be returned, and therefore all sales are final. Members can elect to terminate memberships before or at the end of their membership period, but no monetary value shall be reimbursed if a membership is terminated before the end of its pay period.

Memberships are not required for visitors to use alexisthegreek.com.

PURCHASE OF GOODS: REFUNDS AND RETURNS

All products and prices described on this website are subject to change at any time without notice. Periodic sales and discount codes are used to promote memberships and digital goods, and such promotions are constrained to purchases made within the window of time which the sales and discount codes are active; sales and discounts cannot be applied to previous purchases. 

Certain goods offered at alexisthegreek.com, such as desktop presets, mobile presets, and other downloads are considered digital goods which cannot be returned, and therefore all sales of such goods are final.

Restrictions

Users, whether members or non-paying Visitors, are restricted from copying any materials from this Site. Copying includes sharing, displaying (including screen-sharing or screen-grabbing), reproducing, distributing, publishing, selling, transferring or transmitting any of the materials and information, whether public or private, obtained from this Site. Any violation of the aforementioned Terms may result in civil and/or criminal liabilities.

Ownership of Information and Materials

Copy, photography, videography, graphic elements, information, and all other materials available on or from this Site, including printed materials and press, are the copyrighted works of Alexis The Greek unless otherwise noted, and any unauthorized use of said property and materials may violate copyright, trademark and other laws. Any rights not expressly granted herein are reserved.

Use of Logos and Brand Name

The AG brand, logo, graphic design elements, free and paid classes and courses, names, and other content may be used only with written permission from Alexis The Greek Digital Media LLC. All other trademarks, brands, and names that may be referenced on the website are the property of their respective owners.

For your convenience and resource, this Site often provides links to other websites or resources in blog posts, online classes, and other instances. These sites are owned and operated by third parties. AG makes no association with such third parties unless expressly written (as with affiliate partnerships) and is not responsible for the availability of, or content located on or through, these third party sites (even in cases of affiliate partnership). A third party link from the AG Site is not an indication that AG endorses the third party or its site, or has any affiliation with the third party hosting site.

REVIEWS

All positive feedback supplied to AG through or in association with this Site shall be considered non-confidential and alexisthegreek.com’s property to use in marketing, promotions, and social proof. By submitting a review, whether stated as such or otherwise, to Alexis The Greek, you agree to a grant to alexisthegreek.com a non-exclusive, transferable, worldwide, perpetual, irrevocable, fully paid, royalty-free license, with the right to sublicense, under any and all intellectual property rights that you own or control to use, copy, modify, display and distribute the submissions. AG may use reviews in any way it chooses in an unrestricted basis.

TERMINATION OF USE

Alexis The Greek may, at its sole discretion, terminate or suspend your access to all or part of this Site, including, but not limited to access to your Account, or any forums or community boards on the Site, for any reason, including without limitation, breach of the Terms. In the event this Agreement is terminated, the restrictions regarding materials appearing on the Site and the representations and warranties, indemnities, and limitation of liabilities set forth in this Agreement shall survive any such termination.

DISCLAIMER

The Alexis The Greek content creation team wants only to provide users with useful, accurate, and current information with this Site, including and not limited to information about social media platforms, algorithms, photography techniques, and other digital business tools and practices. Accordingly, AG has attempted to provide accurate information and materials on this Site but assumes no responsibility for the accuracy and completeness of that information or materials. Not all previously published content may be updated when third-party apps, softwares, sites, tools, algorithms, techniques or offerings change or become unavailable, and therefore old content may be inaccurate or out of date. Alexis The Greek Digital Media LLC cannot be held liable for articles or other content consumed by users that users do not cross-check and verify with sources closer to such third parties.

AG reserves the right to revise these Terms and/or legal restrictions at any time. Users are responsible for reviewing at least once per calendar year, and encouraged to revisit the Terms more often than once per calendar year, to ensure compliance with the then-current Terms as they will be binding for Users and members of AG.

GOVERNING LAW, JURISDICTION AND TAXES

GENERAL PROVISIONS

Entire Agreement

If any provision of this Agreement is deemed void, unlawful or otherwise unenforceable for any reason, that provision shall be severed from this Agreement and the remaining provisions of this Agreement shall remain in force. This contains the entire Agreement between the User/Visitor and Alexis The Greek concerning the Visitor’s use of the site, and the Agreement shall not be modified, except in writing by Alexis The Greek.

Notices

Any notices or other communications provided by Alexis The Greek under these Terms, including those regarding modifications to these Terms, will be given via email, or by posting to this Site. For notices made by email, the date of receipt will be deemed the date on which such notice is transmitted.

Waiver of Rights

AG’s failure to enforce any right or provision of these Terms will not be considered a waiver of such right or provision. The waiver of any such right or provision will be effective only if in writing and signed by a duly authorized representative of Alexis The Greek. Except as expressly set forth in these Terms, the exercise by either party of any of its remedies under these Terms will be without prejudice to its other remedies under these Terms or otherwise.

Compliance with Laws

In your use of this Site, you shall comply with all applicable laws, including but not limited to, as applicable, requirements related to capturing verifiable consent, obtaining parental consent, responding to data subject requests, complying with international data transfer laws and other requirements relating to personal information, data localization, cookies and record-keeping requirements.
